TERMS AND CONDITIONS
HUAWEI #COLOURFUL LIFE PHOTO CONTEST (“Contest”)

1. You have full authority to choose whether to participate in this Contest. Your participation in this Contest in part or in full shall be deemed as you having fully read, understood and accepted all terms and conditions contained herein . If you do not agree to any of these terms and conditions, you must not proceed to participate in the Contest.
2. This Contest is organised by Star Media Group Berhad (“STAR”) and sponsored by Huawei Technologies (Malaysia) Sdn. Bhd. (“HUAWEI”)
3. This Contest is open to all residents in Malaysia, aged 18 years and above at the time of entry save and except for: -
   1. permanent and/or temporary employees of STAR or HUAWEI and/or its respective subsidiaries and/or its affiliates, and their immediate family members (defined as parents, siblings, children or domestic partners, regardless of where they live) or households of such officers, directors, employees, agents and representatives; and
   2. representatives and/or business partners (including advertising, promotion and public relations agencies) of STAR or HUAWEI and/or their immediate family members (defined as parents, siblings, children or domestic partners, regardless of where they live) or households of such officers, directors, employees, agents and representatives.
4. The Contest will commence from 6th April 2019 at 12.00am (GMT+8) and ends on 5th May 2019 at 11.59pm (GMT+8) (“Contest Period”). Entries submitted out of the Contest Period will be automatically disqualified.
5. There are six (6) prizes to be won in the Contest. Each participant can only win one (1) prize. Breakdown for the prizes are as follows:-
   • Grand Prize: 1 unit x Huawei P30 Pro (8GB + 256GB Variant) (worth RM3,799)
   • 1st Runner-up Prize: 2 units x Huawei Nova 4 (worth RM1,899 each)
   • 2nd Runner-up Prizes: 3 units x Huawei Watch GT (worth RM899 each)
6. In the event of any prize being unavailable for any reason, STAR and/or HUAWEI has the right to substitute the prize with any other product of similar value. All prizes are non-transferable, non-refundable and non-exchangeable for cash or for any other prizes. All prizes are given on an “As Is, Where Is” basis.Entries to the Contest will only be accepted once these terms and conditions are agreed to in the submission process.
7. All submissions shall be images captured by HUAWEI phones (i.e.: nova 3, nova 3i, nova 4, nova 4e, p9, p9 plus, p10, p10 plus, p20, p20 pro, mate 9, mate9 pro,mate10, mate 10 pro, mate20, mate 20 pro, mate 9 PD, mate RS, mate 10 PD, nova 2 plus, nova 2i, p30, p30 pro and mate 20 x) without limitation to when you captured the images and with which HUAWEI phone you have done so provided always that the images contain the watermark of HUAWEI. You warrant that you have independent, complete, explicit, and uncontroversial copyright of your submissions and that such submissions do not infringe upon the rights of any third party, including but not limited to the copyright and rights of portrait, reputation, and privacy. Your participation in this Contest shall be deemed that you have agreed to this condition. All legal liabilities for any disputes arising from your breach of the aforementioned warranties shall be borne by you. STAR and HUAWEI shall not assume any liability in this regard.
8. The images you submit can only be processed on a HUAWEI phone (third-party processing software on HUAWEI phones is acceptable). The pixel of the shorter edges of the images shall not be lower than 800 pxl, and the data volume of a single image shall not exceed 20 MB.
9. You shall not, in part or in full, adopt any means to use images belonging to others in your submissions. All legal liabilities for any disputes arising from your violation of the aforementioned condition shall be borne by you.ging to others in your submissions. 10. Image of a child/infant can only be submitted by a parent/legal guardian of the child/infant featured in the image.
11. STAR does not pay any fees or return any submissions, and accepts electronic submissions only. Unless otherwise specified, you shall be solely responsible for all ancillary costs in connection with your participation in this Contest.
12. You agree to abide by the laws and regulations of Malaysia, and shall not release or upload any form of subversive, pornographic, violent, terrorist, or other illegal and/or inappropriate information. Submissions that violate any applicable laws and regulations or that STAR and/or HUAWEI regard as disrupting social order or public ethics shall be automatically disqualified from the Contest.
13. Submissions that do not comply with any of these terms and conditions shall be automatically disqualified from this Contest. STAR is entitled to reclaim the awarded prizes in the event that the submission violates any of these terms and conditions.
14. You hereby expressly, unconditionally and irrevocably authorize STAR and/or HUAWEI to use your submissions for campaigns and product and brand marketing for free, including but not limited to using your submissions in network media, print media, printings, photography exhibitions, retail stores, road shows, digital content, out of home media and other marketing activities without further reference and/or payment to you.
15. All materials on the Contest’s website are protected by copyright laws andyou are strictly prohibited from using any material contained therein (including duplication, modification, uploading, presentation, transmission, distribution, licensing, sales, and publication) unless otherwise permitted by STAR in writing.
16. While STAR will use reasonable efforts to include accurate and up to date information in the Contest’s website, STAR makes no warranties or representations as to the accuracy, correctness, reliability or otherwise with respect to such information, and assumes no liability or responsibility for any omissions or errors (including, without limitation, typographical errors and technical errors) in the content.
17. Use of and browsing on the Contest’s site is done at your own risk. Neither STAR nor HUAWEI, nor any other party involved in creating, producing, or delivering the Contest’s site, nor any naming right sponsors, event sponsors and third parties affiliated with STAR and/or HUAWEI and/or its partners shall be liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, or browsing the Contest’s site, or downloading of any materials, data, text, images, video, or audio from the Contest’s site, including, without limitation, damage to, or viruses that may infect, your computer equipment or other property as a result thereof. Without limiting the foregoing, everything on the Contest’s site is provided to you "as is" without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
18. STAR will select the best twenty (20) images from all the valid submissions received in accordance with the terms and conditions herein. A panel of independent professional photographers will choose the winners of the respective prizes. Winners will be notified via email or phone. If a winner is not contactable within three (3) attempts, then his/her position shall be granted to the participant who ranks immediately below the said winner.
19. PERSONAL DATA PROCESSING STATEMENT (“Notice”) ”) IN ACCORDANCE WITH PERSONAL DATA PROTECTION ACT, 2010 OF MALAYSIA (“PDPA”) AND PUBLICITY
    • The PDPA governs the processing of your personal data (“Personal Data”) by STAR and/or HUAWEI. This Notice is issued to inform you that this is the basis upon which the processing of the Personal Data is done by STAR and/or HUAWEI.
    • Purpose: All information (including Personal Data) submitted by you in the course of your participation of the Contest shall belong to STAR and/or HUAWEI and you irrevocably and unconditionally consent and permit STAR and/or HUAWEI to use, publish or feature your identity and/or pictures (which may include your name, statements about the Contest or any of its related matter) without further notice or compensation for publicity, advertising or any other related purposes in any manner whatsoever, including but not limited to in any of the publications, websites and/or any promotional materials connected to the Contest.
    • Transfer: Personal Data will be kept confidential by STAR and/or HUAWEI but you agree that for the Purposes set out herein above, STAR and/or HUAWEI may transfer or disclose such Personal Data to the following parties within or outside of Malaysia:
      1. Other partners or any participating partners which owe a duty of confidentiality to STAR and/or HUAWEI;
      2. STAR’s and/or HUAWEI’s agents or contractors under a duty of confidentiality to STAR and/or HUAWEI providing administrative, telecommunications, data processing or other services to STAR and/or HUAWEI in relation to the Contest (such as but not limited to professional advisers, customer call centre providers, gift redemption centres or data entry companies);
      3. Any affiliates that owe a duty of care to STAR and/or HUAWEI;
      4. Any law enforcement agency and/or regulatory body for compliance with applicable laws, rules, regulations, codes and/or guidelines and/or any person or entity to whom STAR and/or HUAWEI is under a binding obligation to make disclosure under the requirements of any law, rule, regulations, code and/or guideline and/or order of any competent court of law, law enforcement agencies and/or regulatory bodies.
    • Access: You have the right to request access to and to request correction of your Personal Data. Nothing herein contained shall limit your rights under the PDPA.

20. Participant hereby agrees and acknowledges that he/she shall provide authentic and complete personal information, such as name, contact number, email address, and correspondence address, for the purposes of this Contest.
21. Winners shall collect their prizes from STAR’s office located at Menara Star, 15, Jalan 16/11, 46350 Petaling Jaya, Selangor Darul Ehsan, Malaysia within three (3) months from the date of notification. In the event the winner is located outside of Klang Valley, STAR may courier the prize to the said winner provided that he/she bears the courier fees absolutely. If a prize cannot be delivered to you due to your own fault (including but not limited to the provision of inaccurate or incomplete contact information by you), it shall be deemed that you have waived the right to claim the prize. In case of the foregoing, STAR shall not assume any liabilities arising therefrom, and no prize shall be awarded to you.
22. All images of the prizes are for your reference only. The actual awarded prizes may vary. In case of quality issues, you shall contact the prizes’ manufacturer or designated distributor directly and follow their return, replacement, and repair rules/policies. By participating in this Contest, you acknowledge and agree that STAR excludes all warranty and/or liability in connection with the awarded prizes and/or the Contest. You shall assume full liability and responsibility in case of any liability, mishap, injury, loss, damage, claim or accident (including personal injury and/or death) resulting from your participation in the Contest, redemption and/or usage of the prizes. STAR shall not be held responsible for any liability, mishap, loss, damage, claim or accident (including personal injury and/or death) in any manner whatsoever suffered by you as a result of your participation in the Contest and/or the use of the prizes.
23. STAR reserves the right to amend any of these terms and conditions at any time without prior notice and the amended terms and conditions will be uploaded onto the Contest’s website at . Please visit the Contest’s website regularly to ensure that you are aware of any amendments made by STAR. Your continued usage of the Contest’s website and/or your participation in the Contest after amendments are posted onto the Contest’s website means you agree to be legally bound by these terms as amended.
24. If this Contest is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of STAR, then STAR reserves the right, in its sole discretion, to amend the terms and conditions for this Contest, modify the Contest, suspend, terminate or cancel the Contest, as appropriate, without prior notice.
25. STAR’s and HUAWEI’s decisions are final and there shall be no appeal entertained and/or allowed. All participants shall not resort to court proceedings to review the decisions.
26. Unless otherwise specified herein, all ancillary costs are the participants' responsibility.
